Among other things, this opinion should be a wake-up call for people waiting still banking on courts to "save democracy" or "check authoritarianism" or whatever. This is as close as a federal judge will get to throwing up his hands and saying "look I'm upset about it too but I don't have the tools!"

He isn't necessarily saying the gov't will defy his orders—just that, in the past, in his mind, the gov't would have voluntarily complied with a finding that a course of conduct was unconstitutional. And now he thinks they won't, so he will release a separate opinion on "remedy."
