Let's be clear: the U.S. had a deal that could have prevented Iran from getting a nuclear weapon. Trump ripped up that deal. Then he started a war instead of doing the hard work of diplomacy to stop Iran from getting a nuclear weapon.

I feel like we typically see these sorts of completely outraged opinions from federal judges a couple times a year across the whole country, maybe a little more often in last few years. Now, in cases stemming from Trump's immigration crackdown, judges are ringing the alarm bell several times a week.

Trump and Republicans keep getting asked what’s next in Iran. Their answers are “hopefully” this or “we hope” that.  Hope is not a strategy, and a plan built on hope alone is how we end up in decades-long wars that cost thousands of American lives.

It’s worth emphasizing that the Supreme Court has propped up this presidential lawlessness. When Congress enacted limits on presidential power in 1973, it included an enforcement provision. If the president said there’s an “emergency from attack” and Congress disagreed, it could order troops home.

The real story is that foreign govts try to "interfere" all the time. In 2020 and 2024 we had mechanisms to catch them, call them out, & mitigate damage. Now, those mechanims are gone & the Trump admin would prefer to exploit "foreign interference" to justify a federal take-over of elections.

All the more reason to harshly judge the leaders of the firms who caved, the prominent former senior government officials who remain at those firms, and at least one firm that actively assisted Trump in this scandalous abuse of power.

And, all the way back last March, I wrote about the capitulation of Paul Weiss and how it was “dangerous for the rule of law and the nation.” Thankfully, others — Perkins Coie, Jenner & Block, WilmerHale, and Susman Godfrey — did fight back.
