Teaching Employment Division v. Smith tomorrow. one thing that sometimes gets lost: SCOTUS used the prosecution of Native religious use of peyote to declare that no one is entitled to religious exemptions from neutral, general laws. and Congress then specifically protected this use, everywhere.

anyway my broader actual take on the issue is that Jain, Grumbach, and Bonica are all basically good faith actors disagreeing on an extremely complex epistemological problem from slighlty differing perspectives (isolating causality vs. prediction) and the Nate Silver is an asshole.
