Ellis now getting into the meat of the injnuction order she says she *will* be issuing, starting with her ruling that plaintiffs have standing to pursue relief.

Judge Ellis is on the bench this morning about to rule in the case about DHS's use of force in Chicago. Things are not going well for DHS — she just accused Gregory Bovino of lying under oath about his use of force.

“Idle facility activations” mostly refers to CoreCivic bringing unused private prisons online — to be used by ICE. In 2023, California stopped using a massive prison which CoreCivic had built in the California desert in the 90s. It sat empty until August. Now it’s ICE’s largest jail.

Here’s Bovino’s logic: anyone protesting is inherently advocating for violence, so his agents are implicitly justified in using physical violence, which does not qualify as “force,” because anything they do to protesters is lawful.
