Some states have statutes which list "political affiliation" (variously defined) as a protected characteristic. But an applicant's prior work experience at ICE or Border Patrol is not a political affiliation. It's just someone working at a company with shitty culture which disqualifies them.

Under federal discrimination law (like Title VII of the Civil Rights Act), a person's status as having worked for ICE or CBP is not a protected characteristic. There are some exceptions that protect military members, like USERRA, but those do not apply to CBP/ICE.
