The reason we separate civil society from the state in the free world is that civil society needs to run on different rules than the state. We cannot impose a uniform code of justice on our free association. We *can*, however, impose norms and treat ppl according to how well they hold to them.

This is how real-life clubs and venues work! Groups that make a huge goddamn mess get refused service. Nazis especially get banned (typically), but also frats and sororities that go too far, and so do fandom groups dominated by abusive nuts who harass the staff. Life is messy. Moderation is hard.

You *do* want to have as much justice as you can manage in moderation, so you should only punish ppl who break the rules (this is a difference from Hazelton--b/c you, unlike Hazelton's state regime, can actually see what these ppl are doing). Arbitrary punishment is not needed.

This means that a site dealing with a wave of abuse needs to figure out which *communities* (ie nests of closely interconnected users) are doing the abuse, and target powerusers among those communities. It can win some over with positive incentives. It can temp-suspend them. It can permaban them.

The most important person to read on content moderation, besides @mmasnick.bsky.social & co. at @techdirt.com, isn't a techie or a specialist on online culture. It's Jacqueline Hazelton. Because content moderation is a war defined by weak 'state' capacity on the ground, but superiority in force.

Considering Disney's recent turn (trying to appeal to Trump and the right, letting Open AI regurgitate their IPs), it really does retroactively put how they handled "wokeness" for the last decade in just such a... manufactured, insincere light. And undermines what genuine talent they do have.

Great institutional feature: in case of impeachment, the vice president takes over — who was chosen by the president. So having a VP who's even more ideologically extreme basically becomes an insurance policy for the incumbent. The founding fathers were true geniuses.
