I have a paper coming out that argues this at somewhat greater length re: FWS, but it is extremely telling that these courts never define sex. The great `trans rights revolution' cases arose *because* courts realised that they could not coherently define sex in a trans-exclusive way.

No, what happened was the religious right in the US, after losing on Obergefell v. Hodges, immediately changed tactics. They held huge conferences outlining their plans to roll back LGBT rights as whole by targeting trans people. They didn't skip a beat. We aren't to blame for our own oppression.

Usually when the government seeks to prohibit or ban something they treat it like a spell. That’s why they often don’t work. But sometimes the government will self-sabotage a ban by having exceptions so wide so as to render the ban ineffective. Like fox hunting, and now like this.

The thing to watch out for is exemptions for healthcare providers, as otherwise the current NHS "provision" for under 18s is very likely to be classed as conversion practices. Except then watch all the anti trans lot register themselves as healthcare providers...

A thread which may well be infuriating for some (many?) as it's clear that government (as well as the EHRC) has forgotten everything it knew about trans people, and replaced it with a bunch of meaningless buzzwords to justify stuff which breaks European human rights law in so many ways.

Frankly it is beyond depressing that we have lost the cross party consensus on fighting climate change and that just as the impacts of climate change are breaking down our normal ways of life that the Conservatives are more than happy to tear down all the architecture in place that we have to fight.

The driver for changing away from this blanket policy was the deaths of 4 trans women in prisons around 2015/16. Now the courts seem to be saying trans people dying doesn't matter, ideology is more important, and more cruelty ensures.
