This is an important point that it seems like a lot of people don't fully grasp. We don't impose *legal* penalties until something is proved to appropriate standards in a court case. But we don't need legal findings to make judgements like "I don't trust him" and vote for someone else.

My go-to example when teaching about derivatives is to compare them to insurance but note that you can trade derivatives without holding the underlying asset, whereas you cannot take out an insurance policy on your neighbor's house because that would obviously create fucked up incentives 🙃
