Notably, FOUR justices would have rewritten the Constitution by fiat. Kavanaugh only concurred because he thinks the law Congress passed in the 1950s granting birthright citizenship governs the case, but he thinks Congress could eliminate birthright citizenship along Trump's lines if they wanted.
