What the guidance goes even further on is, if you suspect someone is trans, they have no way to disprove it. Even if you have a female passport, you aren't going in the women's gym if someone thinks you're clocky. This is a legal nightmare.

Fundamentally, the structure the Supreme Court has built is that we have a whole act prescribing how you change gender (GRA2004) and a protected characteristic of changed gender (EA2010) which combine to provide no legal protection for having changed your gender.

You know I was having a conversation about something at work today that is so unrelated but maybe applicable here. We were discussing new policies and wondering what the point of some are when there’s no defined actionable response to a breach (as here). Conclusion was “to change behaviour” ☹️

I don't think it's a good idea to legally privilege someone else's discomfort over another person's rights.

If you think someone is trans, you can ask, however be sure to ask in a say that wouldn't put them at a disadvantage or seem hostile or that is harassment. If they deny it, you can ask them to prove it, however there aren't any documents that would work to prove it. Hope this clarifies things.

The election is over, and a new parliament is setting up at Holyrood. Equality Network and Scottish Trans are looking forward to working with MSPs who wish to make Scotland a better place for LGBTQIA+ people, and all marginalised people, over the next five years.

The fact this has been allowed to happen again and again undermines our democracy and the integrity of our election results. The Electoral Commission is there to ensure that people get the results they vote for, and they have failed to do so!
