Judge will tell the jury, “The phrase ‘bodily harm’ as used in this sentence…carries the same meaning as injury in the next sentence.” The sentence at issue is the one defining “assault.”

Judge is deciding whether to define bodily harm and injury as interchangeable — which the government wants, and the defense decidedly does *not*.

If a sandwich can cause bodily harm through armor, either the government needs to sue the manufacturer, or Subway needs to be arrested for distributing weapons.

The note is a question: “Please define ‘bodily harm’…How is ‘injury’ different from bodily harm?”
