Something that bothers me deeply. In the legal academy, we lack formal mechanisms for peer review— this has pros and cons. Many of our institutions have only a couple of experts in any one area. This seems very right to me - along with other points in the thread. It isn't ideal that the modal grade in a lot of institutions & departments and courses is an A, but solutions focused on increasing variance in grades or decreasing average grades etc are probably going to exacerbate other issues.
