It remains baffling to me that we have a clear constitutional requirement that the president can't enrich himself on the job, something we had no problem enforcing strictly for hundreds of years, and then this sweaty conman came by and the nation just sorta shrugged it off.

My only quibble with this otherwise accurate explanation of Hochul's budget is that it's not even clear that the Uber/Hochul evisceration of coverage for certain victims of traffic violence will reduce premiums for motorists. It's claimed, sure, but not obviously true.

I am attending a CLE discussing the new Uber/Hochul rules limiting Uber's (and other motorists') exposure for negligence and the upshot is that too many people harmed by negligent motorists will have no remedy. Great job, Gov. I look forward to enjoying all the "affordability" you promised.

This is kind of an insane thing to write as a specialist in "the psychology of traffic and road rage." Most (adult) cyclists have driven before - even around cyclists! - as I do probably weekly. We don't lack understanding of the motorist's woe; we are worried about not dying while we commute.

Itās worth noting that when Jan. 6 happened, the pro-Trump right used dozens of conspiracy theories to try and offload blame from themselvesāe.g., claiming it was āantifa,ā āfeds.ā Now, they seem keen to just admit they did itāall of itāand it was good.

I think it's reasonably likely that in the next few months we'll see more, not fewer, attempts by the regime to use the DOJ to punish political "enemies." They're panicking and we know, from Kushner, that Trump's superpower is his ability to go lower than you thought possible.

Generally speaking, legal outlets should avoid using the term "settlement," which occurs in the context of real litigation, for a case that was never litigated, where the parties were acting in concert, and where the putative defendant never filed a single document with the court.

I had thought that given its history the SDNY might be somewhat distinguishable from the dumpster fire that is the rest of the DOJ, but Jay here is clarifying that our local federal prosecutor thinks it's his job to parrot his boss' talking points about the flagrantly improper J6 slush fund.

Brett Shumate furiously asking for authority to up his pathetic $25k signing bonus offer to an amount sufficient to entice lawyers to engage in unethical conduct they'll have to justify, in person, to federal judges. $250k? $2.5M? Maybe he can use the $1.8B slush fund that Todd put together.

It is my hope to one day force a placard perp to pay for harm caused by their theft of public space. Because it's undoubtedly the case that some of the injuries sustained on Chambers arose from cyclists forced into traffic by folks parking their cars in no standing zones. I wish the NYPD cared.

That a guy like Walden thinks he can be this overtly racist against Muslims says a lot about what's "permitted" in discourse and what is not. I mean obviously he's gutter trash, notwithstanding whatever pedigree he may have. But he'll still be welcome in polite society given his chosen target.

Drivers often lie about how they came to strike a cyclist. Sometimes their insurer credits those lies, and threatens victims by suggesting they committed insurance fraud (see below). Three years after this threat, guess who just offered to settle our suit for every cent of its policy limits?

The only guaranteed outcome of this policy is that many victims of traffic violence will experience financial harm. Its claimed benefits are speculative and IMO, unlikely. But Hochul/Uber were more than willing to impose that loss on the off chance they might modestly reduce premia for motorists.

There is no clearer case for the necessity of Section 2 of the Voting Rights Act of 1965 than how quickly southern states moved to eliminate Black-majority districts and dilute Black power after SCOTUS eroded Section 2. SCOTUSās reasoning was immediately disproven by reality.

This is an important issue. Often the 1st question from the insurance company lawyer is "what kind of e-bike?" And then I may have to explain to the client that their "e-bike," which they believed to be road legal, may make it more difficult to recover for their serious injuries. Clarity is needed.
