This conversation was one of the most moving moments in my graduate education. Seeing 100+ students listen to each other through anger, pain, and common ground. My law school allowing a platform for this mattered and it is work that must continue to fight the battle against censorship.

This past week, I co-moderated a school wide conversation about politics, Charlie Kirk, and campus speech with my RA. Many of my colleagues, while supportive, were fearful for me. And understandably so. It's a risky move as pre-tenured faculty. The discussion was great. I'm proud of my students.

I think the Kimmel stuff is quite serious and bad, but taking a rich guy off the air for speech is not as harsh as agents of the state grabbing someone over speech and deporting them without due process, and the latter person is clearly more vulnerable, come on.

I think the answer is that the government directly threatening ABC to force a firing would be a First Amendment violation but ABC being cowardly assholes complying in advance in their moronic quest to satisfy Trump is not.

I think this is helpful framing and a good thread. Adding my own question/thought: Isn’t there a fair bit of research that at least some of the mass shootings/school shootings have been driven by the shooter’s desire to be infamous?

Remember when the right and the centrist dems kept rallying around the evil that was progressive “cancel culture”? We’ve seen it before, but this moment is shining a spotlight on their hypocrisy. What's fascinating about the Kirk shooter being a "groyper" (is that confirmed?) is that it adds this entire new layer of complexity to the mainstream discourse that "normies" cannot comprehend unless they're in these circles. This has utterly transcended mainstream politics.

It’s extremely concerning that people in the media are already trying to use this shooting as justification for more online censorship/control, feeding into BS moral panic narratives. Dismantling free speech and civil liberties only bolsters authoritarianism, it doesn’t dismantle it

The news broke while I was lecturing on “lawful but awful” speech in torts today. We were discussing IIED and I was teaching Snyder v. Phelps when a student asked why we protect speech that we know can be so harmful. Surreal. One of those moments that will stay with me forever.

As someone who aspires to be a constant defender of the rule of law, I’m just distraught by everything right now. Things fall apart.
