Serious question: When common law courts prejudge cases, are the resulting decisions law?

At the same time, that article gets hand-wavey with regard to things like professional advice. For example, why is "it should warn you that if you consult a lawyer, the lawyer will owe you a duty and you can sue the lawyer for screwing up" a more rational solution than "just sue the AI company?"
