Where's the premier while MLAs rush through an all-night debate on stripping Albertans of their Charter rights? An airport lounge, waiting for a flight to Saudi Arabia. She didn't even bother to show up for the vote. I remember when conservatives turfed premiers for this level of hubris.

Populists like Danielle Smith also skip legislative and judicial scrutiny. Invoking time allocation. And the notwithstanding clause. Because they can't hack the hard work of liberal democracy. It's not conservative at all. It's negligently lazy.

The days ahead will be crucial. Not just in terms of public opinion, but in terms of political culture. Champions of human rights and the constitution must not only outnumber the premier's supporters. They must persuade Albertans that these positions are dominant, piercing the populist bubble.

I try to be professional on this platform but there are times, like now, when it hits me hard on a visceral level that we are in the midst of a catastrophic global public health crisis and it seems, as a species, we've somehow decided that ignoring it is the best plan we've got.

Let's be clear about what happened today. Premier Smith introduced a bill to strip Albertans of Charter rights, denied MLAs the opportunity to debate it and the courts the ability to scrutinize it, and did all of this from her seat on a jet to Saudi Arabia.

A shameful day for Alberta. Trans people will be next. An attack on one person’s constitutional rights is an attack on all of our constitutional rights. We need a general strike, massive and repeated protests, a recall petition on Danielle Smith, and for this government to collapse.

What's the hurry? In just 6 years, the UCP has been responsible for nearly half of all time allocation motions in Alberta history. They're promising to do it again today, this time ramming through a bill that removes Charter rights in a matter of hours.

Backbenchers in the UCP caucus (and there aren't a lot of them, given most government-side MLAs are in cabinet) have a lot of control over whether to pass Bill 2 with time allocation and/or the notwithstanding clause. They could simply ask for it to be passed as a normal bill with full scrutiny.+

Separately, time allocation & the notwithstanding clause have their place in Canadian democracy. Combined in the way the UCP is contemplating, they're toxic. Just like the Sovereignty Act, their combination removes legislative & judicial brakes on the premier's power. Anything but conservative.

FWIW, the notwithstanding clause says that legislatures are empowered to breach certain rights and freedoms. Not premiers. Time allocation removes the ability of MLAs to fulfill their constitutional responsibility to Albertans. Perhaps that's the point.

Meanwhile, in Manitoba… At least one premier has a grasp of just how serious using the notwithstanding clause is… And is taking steps to ensure that at least one province doesn’t use it before hearing from the courts. #abpoli #ableg #cdnpoli
