Remember when Trump was caught on camera saying something corrupt to Kennedy and obviously shocking him? It’s not the biggest problem but, legal academia’s religious adherence to formalism has greatly contributed to Trump’s destruction of the rule of law.

The thing that resonates most with me in the Klein\Coates NYT convo is Klein’s implicit Utopianism, which is an impulse I always distrust (left, right, or in Klein’s case, center). Coates is bringing his experience as a black American to the convo and it’s giving him a realist’s perspective.

This is not a trivial point. Kavanaugh would say, “obviously I wasn’t talking about assault and battery being constitutional,” but this is an obvious knock on effect of the rule he created. Dont let them bury their heads in the sand like dumb fucking ostriches.
