1/ I believe the the Equal Treatment Bench book is both discriminatory under EA 2010 (notwithstanding FWS) and under HRA 1999/ ECHR. The 2024 update was pretty awful, but the May 2025 update completely takes away all dignity from trans people.

A point I just realised about the Darlington Judgment if confirmed. If having a changing room (even with cubicles) open to the opposite sex is indirectly discriminatory, then all gender neutral changing rooms are indirect discrimination. 1/ Just so we are clear, the Judge is saying trans women never had the right to use female changing rooms. So in 1994, trans women with a GRC could NOT be excluded for a job with intimate care by virtue of a GOQ. Its impossible that she had the right to do that but not to use the changing rooms.

If the EHRC were doing there job, they'd intervene in all 3 cases and request a joined appeal to get clarity. But they wont. They never do, I had to do their job years ago. Lost the case but did get legal certainty between conflicting judgements.
