The Court is redrawing the boundaries of the US voting public. You can't elect or legislate your way out of a rigged electorate. FDR could threaten to pack a court to end Lochner, to overturn Plessy we needed an extra-legislative mass movement and to overturn Dred Scott we needed a civil war.
