I think we need to talk more openly about how white men in the U.S. benefitted from affirmative action for 200 years (i.e., systematic exclusion of women/minorities). This concept is missing from the national discourse and the public's understanding of the context underlying DEI initiatives.

When faced with the prospect of a possible lawsuit, many outlets will think twice about their hiring choices. This isn't about merit v. diversity (a stupid construct, IMO). In this climate, even the most qualified women and minority candidates may be passed over to mitigate litigation risk.

But prevailing in court is probably not the EEOC's goal. While this lawsuit takes aim at the media behemoth that is the NYTimes, its true impact will be in smaller newsrooms across the country, where management will worry about putting themselves in the EEOC's (and the Administration's) crosshairs.

The lawsuit began when a longtime editor sought a deputy editor promotion and was denied. He claims that he was passed over in order to meet the paper's stated goals for improving the representation of women and minorities at the paper.
