Like if they charge you for engaging in constitutionally protected speech—informing others about the presence and location of law enforcement in open channels—your job is to litigate that, everyone else's job is to make sure you have a good lawyer.

I know all eyes are on Minneapolis, but there's a fast-approaching nightmare in Springfield, Ohio. Trump is revoking protected status for tens of thousands of Haitians living there on Feb. 3. Reportedly, on Feb. 4, 1000 ICE agents are arriving to remove this population. Ethnic cleansing.

Tonight, on behalf of Minnesota law enforcement, I filed a lawsuit against DHS to prevent the destruction of evidence related to the fatal shooting of Alex Pretti. DHS is not above the law, and Alex sure as hell is not beneath it.

As an elections attorney, I’ve been following this activity closely since this summer and it’s very bad. It will require major public outrage and the involvement of Congress and the federal judiciary to resolve things in a manner that preserves the integrity of our elections.

I know we’re hearing about this on the news, but watching someone get grabbed off the street from this perspective is so different. It made my stomach turn. It’s almost unbelievable, but no, it’s just a random Sunday afternoon in a city under federal occupation.

I don't think Walz is likely to deploy NG on ICE officers. That's a fair criticism. But from a practical standpoint it has also injected that idea into the public discourse as something acceptable and necessary for Serious Democrats to consider. This is probably useful.

If you witness or experience abuse by ICE, report it. Email DHS Civil Rights at [email protected]. Complaints create official records for lawsuits and investigations. Do not rely on one channel. File everywhere. Send videos and details. Contact congressional offices and the ACLU.

If you’re a citizen and you’re arrested for lawfully recording, monitoring, and objecting to law enforcement, that’s a terrible thing - but you will also absorb so many of their resources by fighting it, and likely win in the end. ICE is grievously outnumbered. THERE ARE MORE OF US THAN THEM.

For context, the appropriations provision which bars ICE from turning away members of Congress from detention centers is only contained in the annual appropriations bill, and limits it to “funds made available … by this act.” So ICE is arguing that if they only use OBBBA funds, it doesn’t apply.

In the lawsuit requiring ICE to provide access, the Trump admin made rumbles about raising this argument. Looks like they’re leaning in. I find it very difficult to believe that they have perfectly avoided commingling funds in the custody operations account.
