Some of my non-lawyer friends are quite up in arms, justifiably so, over Pam Bondi's attempt to exempt DOJ lawyers from state bar disciplinary proceedings. But I'm reading the rulemaking and I'm mystified as to how she thinks she has the authority to do this, or why state regulators would accede.

In fact, I have little doubt that almost all trans individuals are matching their visa applications to their passports even when that means suffering the indignity of that _not_ matching their gender identity, in which case this is a threat based on identity alone rather than any type of fraud.

Even if you believe they're misrepresenting something (they're not), misrepresentation in an immigration context has to be material. The only way this is material to anything is if there is a visa category available to men or women but not both. That would be obviously prohibited.
