We are happy to advise that the Assembly of First Nations (AFN) Chiefs in Assembly adopted Resolution No. 05/2026 in support of Bill S-205 (Tona's Law).

Indigenous Peoples remain increasingly overrepresented in federal custody, while Indigenous-led alternatives under sections 81 and 84 of the Corrections and Conditional Release Act continue to be underutilized.

This failure is evident in every level of custody. In youth custody and segregation in Structured Intervention Units, which subject individuals to some of the most restrictive conditions of confinement in federal prisons, an alarming 96+% of women placed in these units are Indigenous.

Tona's Law represents a meaningful step toward decolonizing Canada's correctional system by ensuring judicial oversight of prolonged isolation and meaningful legal remedies when correctional authorities act unlawfully.

It also breathes new life into sections 81 and 84 of the Corrections and Conditional Release Act by facilitating the sovereignty of First Nations to support Indigenous Peoples to serve their sentences in their respective communities.
