It’s telling how the Christian right’s role in getting Skrmetti to SCOTUS is being erased—and by those seemingly desperate to blame trans people for asking for “too much.” So I spoke with legal historian @kredburn.bsky.social and ACLU attorney @chasestrangio.bsky.social, who argued the case:

This framing is beneath contempt. The Christian right and MAGA launched an unprecedented assault on the civil rights of a tiny minority and successfully weaponized the pseudoliberal establishment - led by the NYT - to provide it with a medical controversy pretext that doesn’t actually exist.

The Skrmetti loss is devastating on many levels. It is basically Geduldig for gender dysphoria. Geduldig never made any sense and was essentially abrogated by decades of sex discrimination jurisprudence that developed later.

#Skrmetti is painful to read. SCOTUS held that heightened scrutiny does not apply to a ban on gender affirming care for minors with gender dysphoria. Justice Barrett’s concurrence says she would not find trans people a suspect classification—a lesson for all who read her Qs at oral arg positively.
