You can not have probable cause to arrest a citizen for being unlawfully present in the United States. IOW, this is kidnapping, and felony assault, and battery, and deprivation of rights under color of law, and the sort of thing that IS probable cause to arrest and prosecute the people who did it.

Recently I learned that civil servants have the First Amendment-protected right to speak out on matters of public concern. Thurgood Marshall, in an 8-1 SCOTUS decision, noted that government employees know how the govât works, and the public has a special interest in hearing from them.

We also expect hits to regulatory employees across DOI. For FWS, we already are short-staffed. Our research branch (science applications) is already gone/absorbed. We have not hired since January (except fire and LE). 20-25% of our employees have departed with the fork or buyout.

Thought I would share this post from May 2 as a reminder. DOI was ready to move forward with RIF actions (layoffs) in May. The courts paused this, but itâs moving again. Word is those consolidated from the agencies to the Department will be big targets. HR, contracting, communication, IT, etc.

Remember what Kavanaugh said about how ICE lets you go if you show you're an American? And the reality that that takes days or weeks? Do the same thing. Let them go if they show they're a fed. But require it to be in the form of 2 official, notarized pay stubs shipped certified mail from HQ.
