The fact it's currently 2-1 (Peggie and Kelly - Darlington) in the Employment Tribunals demonstrates pretty clearly that whatever else the Supreme Court delivered it did not deliver clarity. (More to follow when we can find a copy of the judgment.)

The effective conclusion of the ET is that trans people have to use third spaces. I think based on very poor legal analysis and uncritical adoption of "gender critical" talking points. But as I say, not binding, and all the relevant issues hopefully to be decided shortly by the High Court.

1/ I've skimmed the judgment, and it's actually quite disheartening. A lot of the evidence and assertions about Rose's conduct in the changing rooms is based on conjecture and heightened distress, which the tribunal acknowledges. But then that is used to justify Rose's use of the room as a problem

The largest number of perpetrators of sexual violence in the UK are white men. Any attempt to place blame squarely on racialised groups is not only racist, but it also obscures the systemic problem of men’s violence against women (within homes, which is the most dangerous place for women).

As former Supreme Court judge, Lord Sumption, has helpfully pointed out today, while organisations are now legally able to exclude trans women and men from single-sex spaces (in the context of sport, clubs, changing rooms, and bathrooms, etc etc) they are NOT legally required to do so.

I personally think it's very dangerous for a British court to have essentially changed the law, I suspect in order to spare the government from having to do so in The Commons. The implication is that basically every legal protection is now under threat through this mechanism.

A reminder: you do not need a biological definition of a personal characteristic to address discrimination that relates to it (see race, sexual orientation, religion, etc). Discrimination is a social and political phenomena, institutionally entrenched, and biology is not the answer to stopping it.

I am stunned, and left with a single question - What is the point of obtaining a GRC now? If 'certified sex' does not confer sex-based rights, then why should trans people go through the arduous process of obtaining a GRC?

The media coverage of this case is a great example of failed neutrality. With the BBC and others saying this case is about “defining what a woman is”, they are capitulating to the GC narrative. This is not about defining womanhood, it is about understanding legal rights protections
