But we should also care about their commitment to the judiciary as an institution. Flouting institutional norms like this risks a serious degradation from within. And there are not many tools that other judges — even Chief Judges — have for constraining this kind of behavior ex post.

1/ Regarding the arrests of Lemon and Georgia Fort, my first thought when I saw it was to ask who would pay for their defense. It’s something you might not have thought of unless you did journalism, professionally, but relevant to the “just go start a newsletter” solution to journalism’s woes.

"Prompting" is not general purpose skill. It's just a synonym for giving instructions. You can be amazing at giving clear instructions, but without domain knowledge *and* awareness of the context and the limits of the entity you're instructing, it doesn't matter how precise your articulation.

It seems increasingly clear the rampant noncompliance with court habeas orders happening in immigration cases now is not a problem of attorney ethics. It’s a symptom of structural, institutional collapse at the department of justice.
