it is actually kind of bananas how unitary executive theorists have taken a straightforward clause requiring the president to "faithfully execute the laws" and transformed it into a grant for the exercise of limitless unenumerated power.

Truth is it's probably natural for presidents to come along and argue that their electoral majority should control. In a way, that's just Fed 51 stuff. What's weird and wrong and unconstitutional and, well, unAmerican is for anyone else, especially the Court, to buy into it.

Obviously the president can pressure depts to issue regs, but the reason they created OIRA/regulatory review is that the power to promulgate regulations is vested by law in executive agencies -- not the president -- and controlled by the Administrative Procedure Act.
