The NCSL told me they could assist in making a complaint to DSS (who manage the DES system I was assigned to at the time), however I needed the provider I had complained about to provide me my file. Which I requested in writing and verbally. I did not receive my file. Do you see how lawful this is?

I would have to have contested each demerit through the 'administrative' mechanism of the 'National Customer Service Line'. Until 2024 this was operated by a company that also operated employment services. No-one has ever been able to explain to me what a 'demerit' is or how the points system works.

In my case, and potentially many thousands of others, I was not ever notified of my obligations under social security law as required in legislation. I incurred enough 'demerits' this way to have my JobSeeker cancelled without my doing anything. I then appealed the cancellation as stipulated here.

It cannot be any sort of valid administrative arrangement where two for-profit contract providers arbitrate this 'dispute' about 'demerits' between themselves, which cannot be appealed directly to DEWR or any tribunal. It's not social security law, it's not administrative law, it is flatly unlawful.
