The important point to remember is NO SHE DOESN'T. What was published yesterday were guidelines for service providers. They impose NO obligations on individuals and are NOT the law. People want you to believe otherwise, to intimidate trans people. But they haven't yet criminalised their existence.

Hassling someone in a public toilet based on your assumption of what's in their underwear IS breaking the law. It is harassment. Don't do it. Taking a photo of someone in a public toilet is also likely to be a criminal offence that will (rightly) land you on the Sex Offender Register.
