Just in case folks are wondering, yes, these orders usually say “and by her referred to the Court” even when the circuit justice who is doing the referring is also dissenting from the full Court action. Here’s an example from … last week: www.supremecourt.gov/opinions/25p... This is deliberate.

Among other things, this certainly seems consistent with how many of us read Justice Jackson’s intervention on Friday—buying a few days, but no more, for the First Circuit and the full Court to rule. Now that they’ve had that time, she’d decide the stay *now*—and would deny it.

In other words, the Court is trying to buy itself two more days to see if the House approves the shutdown deal (which may well moot this case), rather than having to rule *now* on whether USDA can be forced to fully fund SNAP for November. And KBJ objects because she’d just deny the application now.
