I'm not saying the Feds cannot be arbitrary and capricious. I'm not saying that someone who gets snarled in a BS prosecution won't have their lives horribly hurt, even if the case eventually gets dropped. I am saying that they cannot do this at scale--and they know this. They need the fear.

The Feds have real capacity constraints. Now, on top of this: • Most AUSAs did not sign up for this. • Most AUDAs likely won't go through with a lot of this (as we are seeing). • And, importantly: there is not a MAGA pipeline that can replace them at scale in a hurry. There just isn't.

Similarly, the fed Eastern District of PA covers Philly and 8 other counties. The EDPA has 140 AUSAs. Krasner has twice that many in Philly alone. The Southern Dist of NY covers Manhattan, Bronx, Westchester, and a few others. Total AUSA? ~200. Manhattan + Bronx + Westchester: over 1,100 ADAs.

Also, it is important to do the staffing math. For example, fed Eastern District of NY covers Brooklyn, Queens, Staten Island, Nassau & Suffolk (LI). EDNY's USAtty office doesn't give staffing, but they prob have ~300 prosecutors (SDNY has 200, EDPA has 150). Those 5 counties: over 1,300 ADAs.

Like Pritzker keeps saying, these EOs are designed to try to scare us into being quiet. It’s important to stay loud for democracy.
