Blanche got no questions today about insisting that loyalists unlawfully remain as U.S. Attorneys, who are rebuked and disqualified by federal judges. Even though that's been a regular and completely unprecedented feature of his stewardship of DOJ.

Ironically, just as Blanche sought confirmation, the Trump DOJ he leads kept thumbing its nose at the advice and consent process for U.S. Attorneys. Federal judges have rejected Trump's unqualified, unconfirmed loyalists in NY, NJ, NM, NV, & LA. This morning, it was Seattle.

As the hearing ended, this remained true.

Grand juries almost never reject indictments. Vindictive prosecution motions almost never succeed. Criminal subpoenas almost never get quashed. It's extremely rare for cases to be dismissed before trial. Stuff like this keeps happening under Blanche's watch. You'd never know it from this hearing.

Asked by Sen. Coons how many Jan. 6 rioters were convicted of assaulting police, Blanche estimates "120, approximately" and adds: "I could be off." "You are," Coons replies, telling him it's more than 200.

Blackburn suggests that Congress will have to do "something" about SCOTUS's birthright citizenship decision. The court upheld that birthright citizenship is guaranteed under the 14th Amendment. She can't change it with a law.

Pressed by Sen. Whitehouse, Blanche won't commit to sharing communications between DOJ and the plaintiffs in Trump v. IRS.

CORNYN gets Blanche to concede that Trump could sue for breach of the settlement with IRS that required DOJ to create the $1.776B slush fund.

Sen. Cornyn comes in with a fastball about the purported settlement agreement — noting that the statute of limitations had lapsed. He asks about whether the parties reached a written agreement to modify the original deal. Bad sign for Blanche.

Well, the president is incorrect here. He appears to be reacting to pre-opinion stories he shared about how Congress could respond if Trump v. Barbara was decided on statutory grounds. But it wasn't. The court ruled 5-4 that the 14th Amendment guarantees birthright citizenship.

Birthright citizenship remains constitutionally protected by the 14th Amendment. But today we learned that U.S. constitutional guarantees — even the "right to have rights" — can be one vote away from being nullified via executive order, if enough justices agree with a fringe legal theory.
