The underlying decision is HUGE. Judge Sykes vacated under the APA "Matter of Yajure-Hurtado," the decision from the Board of Immigration Appeals that had blessed the Trump admin's new interpretation of a 1996 law to deny the right to seek bond to huge swathes of people it takes into custody.

Someone has sure already made this observation but the fact they can convert all those empty warehouses into prison camps means they could have converted them into housing, community centers, job training centers or, hell, libraries or schools all along. It’s always a matter of will not resources.

In case it needs to be said: a spike in habeas petitions is NOT a good development. It means the U.S. is incarcerating more immigrants than ever and further violating the Constitution. Habeas petitions are the last line of defense against outright executive expulsions.

Puerto Rico hasn't had reliable power in a decade. The grid sends occasional surges through the wires that fry appliances. Electricity rates are among the highest in the entire U.S. Heat waves are getting intense in the summer, and outages mean A/C is no guarantee for an aging population.

AWFUL news tonight. This blesses the “mandatory” detention in the 5th Circuit without bond (and little chance at habeas) of every undocumented immigrant who originally entered across the border, no matter how many decades in the past. It will fuel ICE’s push to transfer people to Texas immediately.

A simple proposal for federal judges frustrated that Trump Regime isn’t freeing people in response to habeas corpus orders: Order that DHS bring each individual to court for their habeas hearing. If the judge grants habeas, the petitioner walks out free. Bonus: huge pre-hearing burden on feds.
