This is also the point of many of the attacks on Middle East Studies faculty and events, the social media campaigns and calls to trustees and disruptions - no attack has to “succeed” to create a climate where risk averse institutions just decide to do something else that won’t cause headaches.

That's the point: To return newsrooms to the way they were and to ensure that news coverage returns to the way it was. As they say, democracy dies in darkness.

When faced with the prospect of a possible lawsuit, many outlets will think twice about their hiring choices. This isn't about merit v. diversity (a stupid construct, IMO). In this climate, even the most qualified women and minority candidates may be passed over to mitigate litigation risk.

But prevailing in court is probably not the EEOC's goal. While this lawsuit takes aim at the media behemoth that is the NYTimes, its true impact will be in smaller newsrooms across the country, where management will worry about putting themselves in the EEOC's (and the Administration's) crosshairs.

The Times has defended its personnel processes and vows to defend itself vigorously in court. Notably, despite the Trump EEOC's statements, DEI measures aimed at addressing historic underrepresentation in employment have not been declared wholly unlawful.

Focusing on representation in newsrooms has helped address these gaps and has provided different perspectives on breaking issues. This seems laudable given the role that a free press plays (or should play) in a democracy.

Personnel decisions may impact news coverage. For years, many, including social psychologists, have noted that Black people are portrayed negatively or stereotypically in media reports. Other groups, including women, maintain that their stories and issues go unexamined in the mainstream press.

To be clear, the @nytimes's diversity goals were put in place to address the historic underrepresentation of women and minorities among the paper's staff. This problem exists at most newspapers, where women are woefully underrepresented in economics and politics coverage and on the opinion desk.

The lawsuit began when a longtime editor sought a deputy editor promotion and was denied. He claims that he was passed over in order to meet the paper's stated goals for improving the representation of women and minorities at the paper.
