House LHHC bill is out. Lots of hits to HHS, but the top line number for NIH is 1% decrease, mostly due to cuts ARPA-H. This seems like a huge rejection of the president's budget request.

Plus, American science depends on free speech and free ideas, on scientists being able to follow data w/o polticial interference. It also depends on a diverse and strong scientific workforce. All of these are being killed by Trump. Young people are dropping out, great scientists are leaving the US.

Vought is destroying NIH from the inside without need for budget cuts, via layers of political review, OMB tricks (see @bbkogan.bsky.social thread today), multiyear funding abruptly, blocking NOFOs, interfering with FACA committees, firing grants and contract staff, and illegally terminating grants.

This is very good news. BUT, as we saw this year when NIH was operating under a flat budget, Trump and Russell Vought can effectively destroy NIH even if Congress holds the budget flat. To stop Vought and make sure NIH can function, Congress must go much further than “no cuts to budget.” 1/

In fact, OGC's email yesterday to NIH staff explicitly referenced the July OGC memo that @aniloza.bsky.social covered in the story above. So while this is good news for now, these grants aren't out of the woods yet. Which is just to say, again, if you have a reinstated grant, SPEND SPEND SPEND!

It's also key to note that NIH thinks it'll have more power to terminate grants for policy reasons starting Oct 1. See earlier reporting from @aniloza.bsky.social. It's possible OGC / NIH is simply waiting to re-terminate until after Oct 1 so they can rely on this (still legally dubious) power. 8/

Notably, OGC also said grants in the case that had NOT yet been reinstated could remain terminated. So if your grant should have been reinstated, but NIH hadn't processed the reinstatement yet, you're SOL. We don't know how many grants fall into this bucket, but I don't think it's too many. 7/

And that seems to be exactly what HHS Office of General Counsel (OGC) thought, too: Yesterday, OGC advised against re-terminations because re-terminating reinstated (and currently active) "will likely be viewed as a reapplication of the now-vacated Challenged Directives." 6/
