As the backlash to generative AI in video games continues to pick up steam heading into 2026, it'll be fascinating to see what is considered "made with generative AI." Can a dev team say they're not using AI if they're writing design docs with Copilot or using chatGPT to make schedules and budgets?

The courts have ruled multiple times that AI output isn't copyrightable because it has no author meaning: 1) AI writing is public domain. You don't own any of it. 2) You can't be sure that the writing in your piece isn't stolen, because authorship be damned, you are responsible for what you sell.

I'm a little more sympathetic to this idea because it's something game designers have thought about for a long time (remember Facade?). The idea of a naturally reactive NPC is interesting in isolation. But as Where Winds Meet showed, the reality is not as interesting as the idea seemed.
