This ruling vindicates what I’ve said all along: People have a right to know when police officers are accused of misconduct and to observe the working of our state’s judicial process. I hope David Sullivan will do the right thing and finally stop wasting public money opposing this basic principle.

The DA’s office finally released the names of officers accused of non-criminal misconduct in May 2024 after a court decision in a separate case but continued fighting disclosure of the criminally charged officers’ names. This ruling means the DA will have to release all the names.

After I filed suit, Northwestern District Attorney David Sullivan used taxpayer money to hire a private law firm to fight against police transparency. Records show the firm charged taxpayers $16,870.84 for its work on the lawsuit as of November. Now the DA must pay my legal fees too.

I filed three administrative appeals, and the state’s supervisor of public records sided with me all three times—but the the Northwestern DA’s office still refused to disclose the names. That led me to file a lawsuit in June 2023.

The Northwestern DA’s office provided copies of the Brady disclosures but blacked out the names of the officers, whether they had been charged with crimes or faced internal investigations for alleged misconduct.

My records request sought the district attorney’s Brady disclosures about police officers. These documents—which are named after a 1963 US Supreme Court decision—are used by prosecutors to inform defendants in criminal cases about alleged misconduct by officers testifying against them.

Suffolk County Superior Court Justice Julie Green ruled that the officers’ names and case numbers cannot be redacted under a state law intended to protect people’s criminal records. The judge ordered the Northwestern DA’s office to produce unredacted records—and pay my legal fees.

NEW: A judge ruled Dec. 30 in my lawsuit that Northwestern DA David Sullivan’s office cannot block the public from seeing the names and case numbers of police officers who have been charged with crimes like possession of child pornography, assault and battery, and driving under the influence.
