Judge Arun Subramanian had already blocked enforcement of the subpoenas until he rules on the motion to quash and had scheduled a hearing on that for Thursday. This aspect of DOJ's response reads to me like "We're going to do the work now that we were supposed to do before issuing the subpoenas."

BREAKING: In response to the challenge to the NYT subpoenas, DOJ in a Monday filing put on the docket today agreed to put off the subpoenas for two weeks as the government takes "particular investigative steps" that it suspects will be relevant to the court in assessing the motion to quash.
