To the extent my country is exceptional it is because we are a country of all people and none. The world made manifest. A nation of nations. A people united in truly radical ideas of freedom, equality, and justice for all. Any attempt to undo this is treason and also seeks to make us ordinary.

I think court reform—expanding the Supreme Court by much more than four judges (27 members?) and introducing both panels and regular cycling of members off the court into circuit courts, massive expansions of other parts of the judiciary, in-house experts, etc.—is an easier political sell too.

very much so. "the country has grown significantly and needs much greater judicial resources" reads as less partisan than "we gotta expand the court to stop losing."

another aside about DHS, not only was it badly designed by morons but its just fundamentally not a normal ~interior ministry~ its a Department for Fighting The Terrorists, basically institutional PTSD manifested into the organizational culture of two of the largest paramilitary agencies in the USG

honestly an Mi5 type domestic intelligence agency without arrest powers that had to defer to FBI who go through normal judicial channels on anything actionable would have been a way better reform post 9/11

one thing that is kinda touched on now that Kash is undoing it, is that when National Security Branch went turbo, FBI basically became a domestic intelligence agency with a law enforcement fringe (which is why HSI became a real agency doing real things)

Essentially any specialized, distinct area of law—patents, immigration, and labor all come to mind—should run through specialized judges appointed based on merit for long terms and supervised by district court judges, to whom their Reports and Recommendations are appealable.

DHS in general was a bad re-org. Give TSA and the air marshals to DOT, customs and civil immigration to state, criminal immigration enforcement to justice, the natsec shit to Justice/DoD, etc. Only border patrol is the one that doesn’t neatly fit into any already existing cabinet portfolio.

In the days after the George Floyd video we had near-unanimity on Chavin’s guilt. I do not expect that in this case. But, I would emphasize that apolitical citizens basically dislike chaos, and Trump is a bringer of chaos

Earlier today a driver killed a person crossing the street in downtown DC. Based on the wreckage, high speed was almost certainly involved. The crash happens the same day Trump's Department of Transportation has begun an attempt to abolish speed cameras in DC.

KEEP IN MIND that this is different from fact-checking Fact-checking can be useful, but it has failed time and time again against this kind of Mara. Fact-checking can be motivated by an ego-centric desire to demonstrate a mastery of facts, and to the extent that it is, it is also delusional

We stand in solidarity with the people of Minneapolis, where an ICE agent killed an unarmed legal observer. Communities everywhere are less safe when ICE and federal agents are deployed recklessly into our neighborhoods. The federal attacks on US cities must end immediately.

Hey remember how Heather Heyer was murdered? The Right spent years using cars as weapons and now suddenly that's a problem because an ICE agent murdered someone trying to *flee*. The parts of 1984 that are relevant are how The Party demands to dictate truth.

imo: yes and no. a lot of the issues are structural, that’s 100% true. but we *could* get much more humane enforcement of current laws even if nothing else changed with better system capacity.
