/3 I think this is likely strategy by Justice Jackson -- she likely believes this route (rather than the stay being considered by the whole court) results in the shortest stay. But few will listen to that because of reasons 1-3, and I can't really fault them.

I think a lot of vested interests are trying to defend the shutdown's current course but it is indefensible. Sure, they should get the ACA subsidies back. But they really need to put a stop to all of this and it is wild, no one is calling for Trump's removal as a precondition.

100% this. The Constitutional order has ceased to exist and Trump's removal is the only possible starting point for reorganizing democracy. Any agreement Dems make with GOP that doesn't include Trump's removal is a deal that the GOP will simply ignore anyway.
