Yes, Congress should be able to do these things. A court this contemptuous of Congress deserves to be packed by Congress, not only to correct these disastrous precedents but also because Congress needs to show both Article II and Article III who’s boss.

The only sociology PhD that I think has served in congress was William Graham Sumner - who quit after one term having come to hate politics vis-a-vis professorial life. This, of course, was a bygone era. Unfortunately, sociologists talk a lot about change but rarely put their $ where their mouth is

Sosa was decided the summer before my 1L year, and defined my work as a clinical student & fellow. It was clear the court wouldn‘t endorse the broadest theories of liability. Still, it’s disturbing to see conservatives say oops it was all a mistake, and give (yet another) free pass to corporations.

This was not in the law. CMS chose this. This is how Social Security Disability works. And we have an entire field of law built around helping people navigate that Byzantine bureaucracy. It’s not unusual to take years to access benefits. Lots of sick people are going to lose their health insurance

Sorry, but law academia at large deserves this. _Even now_ Bainbridge makes fun of folks like @gowder.io who saw this coming when Elsevier took over. No one in the social sciences where SSRN originated is gnashing their teeth bc they built alternatives like RePeC, @socarxiv.bsky.social or PsyArXiv

SocArXiv accepts law papers, as we always have. Some of the bells and whistles he wants we don't have- like ranking and email subscriptions, but those can be built using SocArXiv. We don't have funds or staff to help build that, but law schools do.
