The Department of Justice just sent ProPublica this response: "The Department sent these letters to all 50 states and the District of Columbia, asking for voluntary compliance in a timely manner with their obligations under federal law to ensure only citizens vote in federal elections.”

Former DOJ lawyer David Becker said this effort to prosecute election officials is unprecedented: "It's a rather transparent attempt at bullying and it's kind of reflective of the panic that is being felt at the DOJ right now."

There was no immediate response from DOJ’s press office to a ProPublica email seeking comment on the letters.

Most states have resisted the Justice Department’s demands that they hand over sensitive voter-roll information. Judges across the country - including in Maine - have ruled that the DOJ does not have authority to demand this data.

Maine and Minnesota are among the states that confirmed receiving the letter. Maine Secretary of State Shenna Bellows said in a statement that the state already runs free and fair elections and she didn't need "another letter from the DOJ trying to tell us how to do our job."

The letter goes on to say an “intentional act” aimed at diluting the votes of citizens could also amount to conspiracy, punishable by fine and imprisonment. States were told to reach out to the DOJ for steps to take "to maintain clean voter lists as required by law."

Any election officer, including the chief election officer of the state, who knowingly retains noncitizens” on the state’s voter rolls or “facilitates noncitizens in receiving and casting ballots could be subject to criminal liability,” the letter reads.

The letters, which have been sent to more than a dozen states, including some where Republicans oversee elections, say the DOJ’s Civil Rights Division is authorized to take criminal action against election officials who fail to maintain clean voter rolls.
