Parking garage lawyer want assurance that there be a stay if there are further proceedings. CA is "Nooooooo!!! Breyer is simply listening to those arguments. CA is showing pictures of unlawful military action. Breyer closes with promise of super quick decision. God speed, Judge Breyer.

Breyer trying to stay down the middle, asking many question and making specific point in response to the parking garage lawyer's nonsense.

Back to the parking garage lawyers - they're arguing again. They're making claims on CA's posse comitatus issues that are pretty unfounded. This guy looks like he's leading an orchestra, waving his pen like a baton in one hand and his other free hand trying to make the violins play.

Discussion of posse comitatus and insurrection act, as more Marines are coming to replace NG, plus the 700 already in LA. CA lays out case of violation. Breyer lays out some argument re court orders. He feels CA is jumping the gun on posse comitatus because it hasn't yet happened.

Breyer stated that our Constitution was written in opposition to a monarchy. My heart beats faster! Now getting into posse comitatus.

Now Breyer is talking about the statute, how it was written and how it was complied with. He's defending the right of the courts to even hear these cases, which the goons have said was not in the court's purview. Breyer's pointing out the Constitutional correctness to hear.

Breyer's had enough of the Fed parking garage lawyers. On to the Ca lawyers. Ca good guys are pretty much reiterating Breyer's side of the discussion with the parking garage lawyers. I sure hope it continues going this well. Breyer is not interrupting with corrections or questions.

Breyer asked if he complied with the statute. Goons try to dazzle him with their bullshit.

The goons are now stating that statute says it shall "pass through" the governor, and that it's good enough just state that in the order to the NG, despite it never having actually gone through Newsom. Breyer reminds them that Newsom is commander in chief of CA NG. Now - "shall" VS "may". LOL!

Breyer reads the order to the CA NG adjutant general that states the order is "through" the Governor. Despite the fact that it never went through Newsom, the fools are contesting it, stating that all they had to do was say that it went "through", despite Newsom never was given said order.

Listening to Justice Breyer on Zoom, as he's trying to get straight answers from Dump's lawyers. He's darned good, and they are not. Their skirting of the questions, giving non-answers, and his calling them out on it are wonderful. So far, so good, really, really good!
