A case I litigated in the Court of Appeals is at SCOTUS today: I think it’s fascinating. Assume a plaintiff sues a Texas and non-Texas entity. The defendants remove to federal court. The district judge keeps the case on improper joinder grounds: the Texas entity shouldn’t have been sued. /1

Every time this happens I worry about disabled voters’ ability to navigate their way to new or limited locations with so little notice.

Infusion Thursday. Have gotten into a nice rhythm with a very experienced nurse who doesn’t give up on my kinda crappy veins. Today she told me all about her vacay through Southern Italy—super adventurous. Because life doesn’t stop for RA, I squeezed in a hair appt before this appt.

Jim Obergefell gave a wonderful talk at Syracuse this evening. So important that we hear the story of litigation from the client perspective.

A lot of the damage that happens during the early yrs of RA is irreversible. Interesting info here about why it may be worth it to start a biologic and skip over the conventional DMARDs during the early days of an RA diagnosis (and how cost so often drives the clinical decision).

I am thinking of the people of Jamaica, and the many New Yorkers with loved ones there, as Hurricane Melissa — fueled by a warming ocean — grows into the strongest storm ever to bear down upon the island.

Today's "One First" explains why Stephen Miller is wrong that ICE officers have "federal immunity" from prosecution for all actions they take in their official duties, and that anyone attempting to prosecute them is committing a felony. Supremacy Clause immunity is a thing, but it's *not* absolute:

Special Ed helps makes kids college ready, college impacts earning potential, and so on and so forth. These harms will take generations to recover from, and so many kids will simply not achieve the equality departments like this envisioned.
