You ask for an order in writing so they can’t deny afterwards that they ordered you to do it, because it’s a bad idea. But if it’s illegal, you don’t ask for it to be written down and obey anyway. You say no and take the courts-martial or whatever.

Trying to amend 212(n) by fiat would probably be even harder to defend in court than a 212(f) proclamation. Anyway, not everyone is in Silicon Valley. Some of us are in Pittsburgh. And not everyone is a systems analyst. I've done H-1Bs for public school teachers.
