What does this mean though? Everyone entering the US is in some sense a new applicant. You have no status while abroad and then you apply for admission in H-1B status. "Only new applicants" could just mean not people already admitted who aren't subject to 212(f) at all.

I think we really need to start using the Executive Office for Immigration Review's formal name more often. It makes it so much more obvious what they are (and aren't).

Based on what authority? Some H-1B fees are specifically written into law (e.g. ACWIA or 114-113 fees). Others are based on the general INA authority to set fees *at a rate to recover expenses*. This would be neither. Fees simply to discourage usage of the program have to come from Congress.

As we all know, the fewer people a country has, the better off it is. It's a perfect correlation. That's why Nauru is the playground of the rich and famous and not a barren phosphatic Australian prison rock. Immigrants don't aid supply of products and services or anything.
