Actually the film is set on the titular Planet of the Apes, whereas both of those statues are on Earth. It's a completely different statue which the apes built.

I wish people would do a little research before posting. In the movie, it's supposed to be the Statue of Liberty from the New York-New York casino in Las Vegas. Thus, the sand makes perfect sense. Some complain that the flaw is having it near water, but that makes sense if Hoover dam collapsed.
