I can get into the weeds on common law dating back to Calvin's Case (see American by Birth), but the TL/DR is that whether you consider text, history, intent, common law, practice, or institutional development, the answer is the same. No, the exec branch cannot do this.

In this thread I said that to detect a big increase in risk (2x greater) would require at least 65 incidents. So, what about going the other way - how small an effect can a 20 incident study detect. You can solve the inverse of the Freedman equation to find out.
