Federal Judges— or staff, but same-same— used "AI" to summarize & draft rulings, issued them w/o checking the work, leading to basic factual errors, & thus undermining the facticity & validity of the rulings entire. Gee. Who Could Have Foreseen. *stares directly into the camera like in the office*

At some point it has to become clear that this tech exists is to create a more toxic society and enrich its owners. These uses are not aberrations but rather the entire purpose.

tl;dr 1. Studies of genAI in the classroom show that it harms learning 2. The quality of AI-generated text is irrelevant to its most negative effects on teaching 3. The way AI has entered the classroom is as a money-making project extracting new labour, not a “tool” serving teachers’ actual needs

It is really really sinking in for me the degree to which LLMs are the ultimate expression of right wing anti-intellectualism. Its proponents are literally mocking the idea that anyone would ever want to learn anything, know anything, develop any actual skill, or have a thought of their own.

The NCBE's Marilyn Wellington just stated that they have NO information on how this exam will impact different racial groups. But they "will be studying that." They have had decades to study previous exams and haven't done it yet! This is beyond a huge concern!!!! #NextGen #barexam

I am not against changing our teaching approach as a general matter. I think law pedagogy is, and must, keep evolving. Do I think a licensing exam should be the motivator? No.

Time to start re-thinking law school exam drafting.

The NCBE's role is not to tell law professors what to teach, according to the NCBE. But adaptations will be required. I really hope a lot of doctrinal professors are paying attention.

So the current UBE assesses all of this already, according to the NCBE. But competency 2 is new to NextGen.

At least there is full portability. Even if you take the so-called "legacy exam."

10 jurisdictions will give this test in 2026. A fully computer based exam. Should be easy to do those mini PTs on your laptops, folks. Also, we know reading online poses difficulties for many students.

This is something every new lawyer will do in practice. Unless they are in civil litigation, no? Good for the DAs and PDs. Not so good for a lot of Big Law folks.

Of course the MPRE won't be replaced. That's a good money maker for the NCBE.

No word on Trusts and Estates. That's not something new lawyers do right now during a time of the greatest wealth transfer of modern times. Am I right???

No one wastes my time like the NCBE. But sure, let's continue to abrogate lawyer licensure to this group. #NextGen #barexam
